Introduction and Acceptance

We at Thunder and Buttons, (collectively, “Thunder and Buttons,” “we,” “our,” or “us”) offer you access to our interactive online websites, applications and services. These terms and conditions, and any additional terms which might apply to certain products, promotions, or services (collectively these “Terms of Use”), govern your use of our websites (collectively, our “Website”), products, or any of our mobile widgets, services or other applications (collectively, our “Applications”, and collectively, our “Services”). Our Services include www.ThunderandButtons.com, and all websites, applications or other locations on which we place these Terms of Use. By accessing or using our Services, you understand and acknowledge that your personal information will be collected, used, and otherwise processed in accordance with our Privacy Policy, and any additional Privacy Policy referenced in our Services.

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING OUR SERVICES. BY USING ANY OF OUR SERVICES (OTHER THAN TO READ THESE TERMS OF USE FOR THE FIRST TIME) YOU ARE AGREEING TO COMPLY WITH THESE TERMS OF USE, WHICH MAY CHANGE FROM TIME TO TIME AS SET FORTH IN “AMENDMENT; ADDITIONAL TERMS” SECTION BELOW. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS OF USE, DO NOT USE OUR SERVICES. THESE TERMS OF USE CONTAIN A MANDATORY INDIVIDUAL ARBITRATION AGREEMENT AND CLASS ACTION/JURY TRIAL WAIVER PROVISION THAT REQUIRE, WITH ONLY SPECIFIED EXCEPTIONS SET FORTH HEREIN OR UNLESS YOU OPT OUT PURSUANT TO THE INSTRUCTIONS HEREIN, THE EXCLUSIVE USE OF FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS ONLY TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS, COLLECTIVE, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE ACTIONS OR PROCEEDINGS.

Thunder and Button Messaging Terms.

SMS Text Messaging. By consenting to receive texts from Thunder and Buttons, you expressly consent and agree to receive recurring service-related and promotional SMS/text messages from and on behalf of Texas Roadhouse through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Service-related messages may include updates, alerts, and information on waitlist, online ordering. Promotional messages may include promotions, specials, cart reminders, and other marketing offers such as free items and local events. You understand that you do not have to sign up for this service in order to make any purchases, and your consent is not a condition of any purchase with Texas Roadhouse. Your participation in this service is completely voluntary.

We do not charge for the service, but you are responsible for all charges and fees associated with calls and text messaging imposed by your wireless provider. Message and data rates may apply from your wireless provider. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to calls and SMS/text messages, including charges from your wireless provider.

You may opt-out of the service at any time. To unsubscribe from text messages reply STOP to any text message. You consent that following such a request to unsubscribe, you may receive one final text message from Thunder and Buttons confirming your request. No further messages will be sent to your mobile device, unless initiated by you. 

The wireless carriers supported by our Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through our Services, any errors in such information, and/or any action you may or may not take in reliance on the information or our Services.
